At present, the police station undertakes a large number of criminal case investigation work. Generally speaking, the quality of handling cases is good, but it still needs to strengthen the work of mutual cooperation, mutual support and mutual restriction with the procuratorial organs. According to the deployment of the Supreme People's Procuratorate, the procuratorial organs will adopt the mode of setting up procuratorial offices or prosecutors stationed in public security police stations for police stations in key areas such as the main urban areas, urban-rural junctions, and high incidence of criminal cases; for small police stations with a small number of cases, they can explore the stationing of procuratorial offices in district and county public security bureaus to supervise the criminal investigation activities of public security police stations under their jurisdiction.
The focus of the supervision of criminal investigation activities of public security police stations will be cases in which the masses have strong reactions, affect social harmony and stability, illegally use criminal means to intervene in civil and economic disputes, cases of illegal evidence collection such as extorting confessions by torture and obtaining evidence by violence, and cases in which compulsory measures and compulsory investigative measures may infringe upon the personal and property rights of criminal suspects.
The establishment of a supervision mechanism for criminal investigation activities of public security police stations is to implement the task of further deepening the reform of the judicial system at the fourth Plenary session of the 18th CPC Central Committee. According to reports, since 2015, the Supreme People's Procuratorate has selected 10 provinces and cities including Shanxi to conduct pilot projects, and 1064 grassroots procuratorates and 8370 public security police stations have participated in the pilot work.
With the strong support and cooperation of the public security organs, during the pilot period, the procuratorial organs supervised the public security police stations to file 5243 cases and put forward 15162 corrective opinions on illegal investigation activities. In many places, by strengthening the supervision of criminal investigation activities of public security police stations, the quality of cases has been significantly improved, the rate of non-arrest has decreased significantly, the number of acquittals after arrest has decreased, and the number of letters and visits to public security police stations has decreased.
Most of the cases handled by public security police stations are "misdemeanor" cases, and some of them can not enter the link of approving arrest and prosecution. It is difficult to find out whether the investigation activities such as filing and withdrawing cases are legal only by the supervision of handling the examination and arrest cases, and it is easy to become a "blind area" of supervision ". Sun Qian, deputy chief procurator of the Supreme people's Procuratorate, said that the goal of procuratorial organs in supervising criminal investigation activities of public security police stations is to ensure the legitimacy of evidence, ensure the effect of charging crimes, and realize the unified and correct application of national laws.
